| When you want us to find a property for you. |
- Our website 'divulged' all information as much as
we can needed for each of the property posted. This
is a company's property. Garces Realty is spending
so much time money and effort to get those informations.
To steal or copy of this proprietary corporate information
is strictly prohibited.
- If you want us to look for a 'Specific Property
for Sale' of your specification, we charge a $100
US upfront fee for the information required. This
includes provision of a certified copy of title, and
a cadastral survey of the property and the cost while
the search is on progress, the information gathering
stage cost to search all property direct to sellers.
You will be given 2 property as choices.
- Should the prospective buyer - with a detailed property
report on hand for the specific property for sale
- seek additional (digital) photographs of an offered
property 'outside metro Cebu', the buyer will pay
(in advance) all transportation fees, overnight accommodation
if necessary, and $50 US per Diem. Most properties
can be visited within 1-2 days. For more remote areas
we will advice you in advance of the (probable) costs
for the inspection tour.
- We charge a $50 US upfront fee for any additional
information required about properties 'already listed'
on our website aside from the detailed property report
listed therein. This includes provision of a certified
copy of title, and a cadastral survey of the property
and or should the prospective buyer seek additional
(digital) photographs of a property.
- In many instances there may be no instant survey
of the property. The buyer has the option to pay for
a survey of a lot - $150 US direct to the surveyor.
The surveyor is from a private survying company.
- If you want us to search a 'Property for Rent' in
Cebu City and or metro Cebu area, a service charge
of $50 US upfront fee will be collected to cover the
expenses while the search is on process. This will
also cover the digital pictures and detailed property
report. You will be given 2 choices of property in
a week time. This upfront fee is non-refundable.
- All pre-payments (except rental property search
charges) are refundable once the purchase is done.
- Should the buyer want his own lawyer to do the contracts
and paperwork verification, the proper cost of the
lawyer will be apply. The cost however is upon lawyers
discretion.
- Regarding on who will pay the government fees such
as the capital gains tax, transfer tax, documentary
stamp tax and registration fees remains to be subject
for negotiation. However the standard procedure is
that, capital gains tax of 6% and 1.5% documentary
stamp tax will be shoulder by the seller. While the
buyer shoulders the 0.5% transfer tax and the registration
fees.
- Garces Realty decided to charge the conditions above
specified to limit unscrupulous, nuisance and speculative
inquiries. After which the property search was performed
and the information was sent via email, the suppose
buyer never 'get back' to response even a single email
confirming his interest or disinterest of the property.
It did not happen 5 times, 10 times but more and more
times this was happened. It's so sad to note somebody
is happy to steal our time. There are instances that
the one who inquire are 'brokers' and after they got
the informations, they go directly to the property
and steal the time, money and effort invested in the
property. Lastly, this will 'confirm your interest'
our dear property investor and home buyers. We would
emphasize that it is not easy to acquire those pertinent
documents and papersworks. The searching itself does
more cost.

| When you are arriving to the Philippines |
- The prospective buyer must inform the company during
their arrival to Cebu or anywhere in the Philippines.
We are not prohibiting you from contacting others,
in fact if you have another property which you are
interested in, we will be happy to offer unbiased
advice. This is to make sure that you aren't defrauded
by unlicensed real estate agents. Even licensed practitioner
is not a guarantee. We hereby suggest you to be cautious
at all times.
- During property inspection tours the buyer will
pay all traveling expenses, including tricycle fares,
bus, taxi or Jeepney fares, private 4WD hire, boat
excursions and any airfares when necessary. The buyer
will also pay any necessary accommodation for the
agent, or agents or brokers the cheapest available
rate.
- No unescorted property inspections. We insist that
all property inspections are conducted with the Broker
in attendance. This is because its illegal to enter
property without the permission of the property owner.
Also, it is Philippine traditional custom for a buyer
to be introduced to a seller by an intermediary -
the broker. Secondly, its impossible for the buyers
to narrate and get the totality of the projects (if
the property is inside a property development) if
unescorted. The agents or brokers in assistance has
undergone series of seminars about those projects
and possesed the total knowledge, such as the proposed
locations of the amenities and open spaces, and in
general, how the development will be fulfilled.
- The buyer agrees not to divulge any of the proprietary
information received from the Broker to 3rd parties,
especially other agents, brokers, and any real estate
marketing company.
- For all interested and eager buyers, you will be
assisted and tripped personally to the property no
less than the Realtor itself. However, if the Realtor
is not available, he will be assigning the task to
one of his Investment Directors.
- All tripping is only designed for buyers and investors
who already decided to buy if and only if the desired
property specification will be met. Garces Realty
will never trip you if your timetable to buy is 6
months, 1 year or 2 years after the date of the tripping.
That would be useless since the property can be sold
out in anytime not unless a downpayment or reservation
fee or a holding fee will be paid commensurate to
the sellers / developers guidelines.
- Strictly the tripping is for business purposes and
is not designed for buyers who just want have a tour
of the area and in any area nearby.
- All Garces Realty agents, brokers and Realtor's
shall never be in any instances be considered a tour
guide. If you want to familiarize Cebu, you must call
a proffessional tour guide.
- There are other agents of other real estate marketing
company who are doing an exhibits / showcase / scale
model with house pictures that can attract buyer's
attention in the airport, hotels and malls. That is
one of the good marketing strategy to promote their
real estate business. However, we found it to be unfair
when clients get so much informations in our website
and will do business with others. We can lament on
how unfair it would be, for a series of buyers communications
thru fax, email, time, and effort for the photographs
or brochures that was shipped thru FedEx / DHL and
series of long distance calls which will equate our
investments. The agent will then convince the buyer
that we are selling the same property and there will
be no difference in prices. Some will say, they can
negotiate the developer / owner to lower down the
price. This is circumstancial. The price in the developers
are fixed while in brokerage, the price can be negotiable
at all times. Although we can't tell clients not to
do it, that would in effect be unfair since 'nobody
should benifit from the sweat of somebody else'.
- Real Estate is an aggressive business. This might
also be a point of misunderstanding between agents.
While you will talk other agents in an exhibit, they
will practically register you as their official clients.
They will let you sign the form and forward it to
different developers claiming you. Once you have a
business appointments to our agents, and consequently
you will buy, those agents will surface claiming the
transaction as theirs because you have signed up their
forms. We suggest you not to sign anything from them.
Although we did not prohibit you from talking to other
agents, we only have one business philisophy: Make
You Happy and avail the most of your Investment and
Fulfill Your Dream Home Ownership in the Philippines.
Although the price and everything is still the same
because we are selling the same property, the 'service'
we will render and our business relationship does
more as our only asset, an evident of worldwide strong
base clients of Garces Realty. Because above all,
we value your satisfaction.
- We are appealing to all prospective buyers to call
on us.
- We would be asking to our clients to be patient
because Garces Realty will then explain to them all
this possible property investment anyway.
- All pre-payments (except rental property search
charges) are refundable once the purchase is done.

| PAYMENTS |
- All payments from overseas can be either by Western
Union, or direct bank deposit. Or an online electronic
banking system of Hongkong Shanghai Bank Corp.(HSBC)
or CITIBANK operating 24/7. All payments and expenses
should be in Philippine pesos.
- We don't accept postal money orders or cheques of
any kind, and its not safe to send cash through the
post.
- No payments through 3rd parties i.e. relatives of
Balikbayans, or other agents; We had once lost money
in this process. If you want added security payments
can be directed to the Manager to Metrobank or RCBC
Savings.
- If you opt to use Bank to bank transfers of any
kind, kindly keep the payment / deposit slip. Fax
it or Email the slip to Garces Realty.
